The Department of Water and Environmental Regulation investigates and prosecutes illegal dumping offences under the Environmental Protection Act 1986 (EP Act).

Illegal dumping is the unauthorised discharge or abandonment of waste and is an offence under s.49A of the EP Act. On conviction, the offence carries a maximum penalty of $125,000 for corporations and $62,500 for individuals.

The department also investigates littering under the Litter Act 1979. Offences under the Litter Act 1979 carry a maximum penalty of $10,000 for corporations and $5,000 for individuals.

We have a dedicated Illegal dumping team that has the capacity to investigate reports of illegal dumping and implement proactive initiatives, including deploying covert surveillance cameras. We respond to reports of illegal dumping from members of the public, through our Program Partners and Local Government Authorities.

We work with our program partners to tackle illegal dumping. We provide technical support and training in investigative techniques, access and use of surveillance equipment and educational material including signage, stickers and scene tape.
