Section 114(3) of the Environmental Protection Act 1986 (EP Act)

The Chief Executive Officer (CEO) of the Department of Environment Regulation (DER) will assess all requests to initiate a prosecution in line with the DER Enforcement and Prosecution Policy. Sufficient evidence will be required to establish that an offence (see Table of Offences shown on the right) has occurred and that a prosecution would be in the public interest to proceed.
